Information Clause for Recruitment Purposes of e-Xim IT S.A.

  1. The personal data controller is e-Xim IT joint-stock company with its registered office in Warsaw, address: Jutrzenki 137 02-231 Warsaw (hereinafter: Controller or Company). The Controller can be contacted by writing to the email address: biuro@e-xim.pl or to the Company’s registered office address. We also inform that the Controller has appointed a Data Protection Officer (“DPO”), who can be contacted by writing to the email address: iodo@e-xim.pl or the correspondence address: as above.

  2. We process personal data received as part of the application for the purpose of conducting the recruitment process and considering submitted candidacies:

    a) in the event that employment is planned based on an employment contract: the basis for data processing is the provisions of applicable law, in particular the Labor Code and implementing acts (Art. 6(1)(c) GDPR), and to a broader extent than specified in these provisions, the candidate’s consent expressed through the voluntary provision of such data (Art. 6(1)(a) GDPR),

    b) in the event that employment is planned based on a civil law contract / B2B contract: the basis is the necessity of processing to take action at the request of the data subject prior to entering into a contract (Art. 6(1)(b) GDPR),

    c) we may also process personal data for the purpose of conducting future recruitment processes, if the candidate gives such consent (Art. 6(1)(a) GDPR),

    d) we may also process personal data for the purpose of pursuing the legitimate interests of the Controller, such as: enabling candidate identification in the recruitment system, or defending against potential claims or pursuing such claims (Art. 6(1)(f) GDPR).


  3. Failure to provide data may prevent the recruitment process from being carried out and a candidate from being selected – providing data specified in Art. 22¹ of the Labor Code is a statutory requirement, providing an email address is necessary for identification in the system, while providing additional data (e.g., image or interests) is voluntary.

  4. Personal data will be stored for the duration of the recruitment process or future recruitments (for this purpose, for a period of 1 year), and then until the expiration of the limitation period for any potential claims (and in the event of a potential dispute being initiated, until the final resolution of the dispute/proceedings).

  5. Recipients of personal data: The Company may transfer candidates’ personal data to entities supporting the Company in the recruitment process; entities providing accounting services; entities providing correspondence delivery services; entities legally supporting the Company (including in the scope of personal data protection).

  6. In accordance with the principles set out in the GDPR provisions, you have the right to: – access personal data, including the right to obtain a copy thereof;– request rectification of personal data,
    – erasure of personal data;
    – restriction of processing of personal data;
    – object to processing;
    – data portability;
    – withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal;
    – lodge a complaint with the President of the Personal Data Protection Office.

  7. Personal data is not subject to automated decision-making, including profiling (as referred to in Art. 22 GDPR).

  8. Personal data is not transferred to third countries (outside the EEA).

If you are interested in participating in future application processes conducted by the Company, please additionally provide the following clause:“I consent to the processing of my personal data contained in the submitted application documents by e-Xim IT joint-stock company with its registered office in Warsaw, address: Jutrzenki 137 02-231 Warsaw, for purposes related to participation in future recruitment processes in the aforementioned company. I acknowledge that the above consent may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.”
